Welcome to BohoMama. By accessing our website and purchasing our products, you agree to the following Terms and Conditions.

This website is operated by BohoMama (“we”, “our”, “us”). These Terms apply to all users of the site, including browsers and customers.
 
By using our website or placing an order, you agree to be bound by these Terms and our Privacy Policy.

BohoMama creates custom-designed products including:

  • Stainless steel drink bottles

  • Ceramic mugs

  • T-shirts and apparel

  • Soft toys

  • Stationery and other personalised items

All products are made to order based on the personalisation details you provide.
 
3. Personalisation Responsibility
You are responsible for:

  • Ensuring all names, spelling, dates, and details are correct

  • Reviewing your order carefully before submission

We are not responsible for errors submitted by the customer. Once production has started, changes may not be possible.
 
4. Pricing and Payments

  • All prices are listed in New Zealand Dollars (NZD) unless otherwise stated

  • Payment must be made in full at the time of purchase

  • Payments are securely processed via Stripe and PayPal

  • We do not store your payment details

We reserve the right to change prices at any time without notice.
 
5. Order Processing and Production

  • All items are custom-made, so production times may vary

  • Estimated processing times will be provided on the website

  • Delays may occur during peak periods or due to unforeseen circumstances

We will make reasonable efforts to meet estimated timelines but do not guarantee delivery dates.
 
6. Shipping and Delivery

  • Shipping costs and delivery timeframes are provided at checkout

  • We are not responsible for delays caused by couriers or postal services

  • Risk of loss passes to you once the item has been shipped

  • Please ensure your shipping address is correct. We are not responsible for orders sent to incorrect addresses provided by the customer.

    7. Returns and Refunds (Custom Products)

  • Due to the personalised nature of our products:
    We do not accept returns or refunds for change of mind

  • We do not offer refunds for errors made by the customer
    However, we will offer a replacement or refund if:

  • The item is faulty or damaged

  • The item is incorrect due to our error

  • You must contact us within 7 days of receiving your order with proof (e.g., photos).

  • This policy is in accordance with the Consumer Guarantees Act 1993 (NZ).

    8. Intellectual Property
    All designs, images, logos, and content on this website are the property of BohoMama unless otherwise stated.  You may not:

  • Copy, reproduce, or distribute our designs

  • Use our content for commercial purposes without permission

    9. User-Submitted Content

  • By submitting custom text, images, or designs, you confirm that:

  • You have the right to use that content

  • It does not infringe on any copyright, trademark, or other rights

  • It is not offensive, illegal, or inappropriate

  • We reserve the right to refuse any order that violates these conditions.

    10. Limitation of Liability

  • To the extent permitted by New Zealand law:

  • We are not liable for indirect, incidental, or consequential damages

  • Our liability is limited to the value of the product purchased

  • Nothing in these Terms limits your rights under New Zealand consumer law.

  • Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 2020 (NZ).
